Baseball League Strikes Out Against SMVT Partner Hugh Stevens
September 1, 2010
SMVT partner Hugh Stevens recently defended a Stetson University baseball player, his summer amateur team, and a Virginia non-profit “wood bat” baseball league against a for-profit North Carolina league that sought an order restraining the player from engaging in any organized or unorganized baseball activity. The local league alleged that it suffered irreparable injury after the 19-year-old infielder changed his mind about playing for the Outer Banks Daredevils and opted to play with the Virginia team instead. Special Superior Court Judge Lucy Inman did not let the plaintiff get to first base, finding that it had not demonstrated either irreparable injury or “any substantial likelihood of ultimate success on the merits.”
