Brandon J. Huffman Quoted on Closed Meeting in Carteret County

July 21, 2014 About SMVT

The Carteret County News-Times has published a story on a meeting between the Carteret County Commissioners and Gov. McCrory.

The article quotes SMVT associate Brandon J. Huffman on whether the meeting, which included a quorum of the Commissioners, might have violated North Carolina’s open meetings law.

“They can meet so long as they are not conducting, discussing or transacting public business,” said Brandon Huffman, a lawyer for the N.C. Press Association. “It can be tricky,” he added.

Lateral discussion of the matter between commissioners could be the issue, in terms of public meetings law.

“If they are talking potential action, foreseeable action, I would take the position that that violates (statute requirements).”
