Judge to Review UNC Enrollment Records

The Chapel Hill News reported recently on the ongoing litigation arising from a records request filed by the News & Observer with UNC-Chapel Hill. The request sought records of fraudulent classes in which student athletes were enrolled.

Soon, a judge will review the records to determine if they fall under the North Carolina Public Records Law, or are exempted individual student records. The judge recently denied UNC’s request to dismiss the suit, and agreed to review the records in private to determine if any athletes could be identified in them.

At a hearing last week, attorneys for the university attempted to introduce an affidavit without allowing counsel for the paper to review it in advance.

SMVT attorney Hugh Stevens, who represents the News & Observer in the action, is quoted in the story:

The irony of this is this is a proceeding about public records, and they want you to turn it into a Star Chamber proceeding where only you and they know what the evidence purports to be.
